Legal Update on Law No. 193/2000 on abusive clauses in contracts

In order to provide tangible benefits to consumers and to meet the need to transpose Directive (EU) 2019/2161 into Romanian legislation, a draft law has been introduced aiming to modernize consumer protection rules. The draft was published on January 7 on the website of the Ministry of Economy.

It introduces a number of significant amendments to Law No. 193/2000 on abusive clauses in contracts concluded between professionals, aiming to clarify various jurisprudential controversies—such as establishing the non-prescriptive nature of the right to challenge enforcement proceedings when the abusive nature of contract clauses included in an enforceable title is invoked.

The sanctions regime is also revised, with proposed changes that could increase the fine thresholds by up to 100 times.
