Carrying out work from home or under a teleworking arrangement involves a number of specific aspects and requires compliance with certain legal requirements and formalities (e.g., those concerning the content of the individual employment contract or the addendum formalizing the parties’ agreement, the work schedule, registration in REVISAL, and especially occupational health and safety).
Things become even more complex when cross-border elements are involved (e.g., in the case of international teleworking).
We recommend that employers carefully review their internal policies and documentation regarding the implementation of remote work, particularly given that labor inspections in this area are expected to intensify in the near future, according to the 2021 action plan published on the Labor Inspectorate’s website.
