Crypto-assets and ICOs and the future EU Regulation

A week ago the European Securities and Markets Authority (ESMA) published a report on crypto-assets and initial coin offerings (ICOs). Also, on the same date of 9 January 2019 another EU supervisory authority, i.e. the European Banking Authority (EBA) released the results of its own assessment of the applicability and suitability of EU law to crypto-assets. 

This is a summary on ESMA’s advice that comes as a response to the European Commission’s request in its 2018 FinTech Action plan for all European Supervisory Authorities, of which ESMA is one, to assess the suitability of the EU regulatory framework in respect of ICOs and crypto-assets.
